1. About the platform
Kohima Rentals ("we", "the platform"), a brand operated by Kohima Business and Logistics Private Limited, is an online marketplace that lets property owners list rental houses, hotel rooms, home stays and paying-guest accommodation, and lets tenants discover, contact, visit and book them directly. We are not a party to any tenancy or stay agreement between owner and tenant.
2. Broker-free pledge
Brokers, agents and intermediaries are NOT allowed to list on Kohima Rentals. Every owner must affirm on each listing that they own or are legally authorised to let the property and that they will not charge any brokerage to tenants. Our team calls and verifies new owners; listings may be flagged, marked 'Broker Reported', or removed if this pledge is breached. Tenants must never pay brokerage to anyone in connection with a listing.
3. Accounts
You must be 18 or older. Keep your login details confidential and provide accurate name, email and mobile details. A verified mobile number is mandatory to use the platform (see section 12). We may suspend accounts involved in fraud, harassment, misrepresentation or repeated policy breaches.
4. Owner identity verification (KYC)
Before publishing any listing, every owner must complete identity verification (KYC) by submitting a live selfie, one government-issued photo ID (Aadhaar, PAN, Passport or Driving Licence) and a valid address proof. The selfie must be an image; the ID and address proof may be an image or a PDF, and each file may be up to 10 MB. You may create and submit a listing while your documents are under review, but listings may be suspended or removed if verification is incomplete, pending too long, or fails. Our admin team approves or rejects each submission and will state a reason for any rejection, after which you can re-submit corrected documents. You confirm the documents are genuine, belong to you, and that you are authorised to let the property.
5. Listings
Owners are responsible for the accuracy of photos, rent, availability and descriptions. Owners must confirm availability when prompted (every 3 days) and mark a property as rented when it is no longer available. Verified listings display 'Verified by Kohima Rental Team'; unverified ones display 'Pending Verification'.
6. Fees
Listing is free for all owners. Rental Houses and Paying Guest: owners pay no fees; tenants pay ₹100 per property to unlock the owner's contact details and settle booking fees, rent and security deposits directly with the owner. Home Stays and Hotel Rooms: tenants view details, photos and contact for free; the owner pays Kohima Rentals a platform fee of 13% of every successful online booking, deducted from the collected amount. In line with GST law, 18% GST is charged on this platform commission fee and is borne by the owner (deducted from the payout along with the fee); it is not an additional charge to the tenant. Any accommodation GST collected from guests is separate and is remitted by us, not paid to the owner. All paid fees are non-refundable.
7. GST (taxes)
GST is applied only where the law requires it. (a) Accommodation GST on Hotel Room and Home Stay bookings is added on top of the listed room price, assessed per room per night: 5% (2.5% CGST + 2.5% SGST, no input tax credit) for tariffs up to ₹7,500 per night, and 18% (9% CGST + 9% SGST, ITC eligible subject to conditions) above ₹7,500 per night. Where some nights of a stay cross the ₹7,500 threshold, each night is taxed at its own rate and the invoice shows both. This accommodation GST is paid by the guest, collected in full online (including on the balance portion of deposit bookings), and remitted by us — it is never part of the owner's payout. (b) Platform-commission GST: an 18% GST applies to our platform commission on Hotel Room and Home Stay bookings. It is borne by the owner and deducted from the payout together with the commission, and is calculated on the full 13% commission even during a platform-funded promotional discount (the discount is our marketing cost and does not reduce the taxable commission). (c) No GST is added to the ₹100 Rental House / Paying Guest contact-unlock fee, the ₹1,400 per month contact subscription, or the ₹200 no-acceptance / cancellation fees. A tax invoice showing the CGST/SGST break-up is issued for every online Hotel Room / Home Stay booking (SAC 996311 — accommodation services).
8. Online bookings — NO CANCELLATION, NO REFUND
Hotel Rooms can only be booked online through the platform, with the full listed amount paid in advance; offline hotel bookings are not permitted. The owner must accept a paid booking within 10 minutes (our team may accept or reject on the owner's behalf after contacting them). Once accepted, ALL PAYMENTS ARE FINAL: the booking cannot be cancelled and no refund is provided. If the booking is not accepted within 10 minutes it is cancelled automatically, the tenant is refunded in full by our team, and a ₹200 no-acceptance fee is charged to the hotel owner's account. Separately, a host may cancel a confirmed Hotel Room or Home Stay booking if it was accepted in error or double-booked; in that case the guest is refunded 100% by our team and a ₹200 cancellation fee is charged to the host's account (the host gets a short window to undo an accidental cancellation before it is final).
9. Balance payments & payout cycle
For Home Stays and Hotel Rooms, Kohima Rentals collects the full booking amount from the tenant and pays the owner on a weekly cycle, after deducting the 13% platform fee, 18% GST on that platform fee, any accommodation GST collected from guests, and any cancellation or other charges added to the owner's account. The payment week runs Monday to Sunday: every payment collected during that week is paid out to the owner on the following Wednesday. If a payout Wednesday falls on a bank holiday, settlement moves to the next working day. For all other categories, tenants pay the owner directly; Kohima Rentals does not hold or guarantee those payments.
10. Offline bookings after a visit
If a tenant books a Rental House or Paying Guest with the owner after a site visit arranged through the platform, the tenant should mark 'Stay Booked with Owner' so the listing can be updated. No platform fee is charged to the owner for such bookings.
11. Payments
Online payments are processed by Razorpay. By paying you agree to Razorpay's terms. We store transaction references and issue PDF receipts.
12. Communications & verification
By creating an account you agree to receive transactional messages about visits, bookings, chats, payouts, listing check-ins and account/verification events through in-app notifications, push, email and WhatsApp. Mobile number (mandatory): every user must add a mobile number, and we verify it by sending a one-time passcode (OTP) over WhatsApp — a number is never added to or changed on your account without this WhatsApp OTP verification. Email verification: when you add or change your email address we confirm ownership by sending a one-time code to that address. Opt-in: once your mobile number is verified, WhatsApp updates are switched ON by default so you never miss booking, visit and payout alerts. Opt-out: you can turn WhatsApp, push or email updates off at any time from Profile → notification preferences (on mobile, Settings → notifications), and you can manage push permissions in your device settings. Turning a channel off stops update and promotional messages; essential one-time login codes and critical booking/payment messages are still delivered, as they are needed to sign in and complete bookings. All OTPs and alerts are sent only to the verified contact details on your account.
13. Content & conduct
You retain rights to photos you upload and grant us a licence to display them on the platform. Do not post misleading, discriminatory, unlawful or offensive content. Reports of broker activity are reviewed by our team.
14. Liability
The platform is provided 'as is'. We do not guarantee the condition, legality or availability of any property, or the conduct of any user. To the extent permitted by law, our liability is limited to the platform fees you paid us in the preceding three months.
15. Termination & changes
You may delete your account at any time from your profile. We may update these terms; continued use after changes constitutes acceptance. Governing law: India; courts at Kohima, Nagaland.
